An automated employment decision tool (AEDT) is a computer-based tool. It is used to screen job candidates or assess employees.

An AEDT helps with employment decisions by using:

  • Machine learning
  • Statistical modeling
  • Data analytics
  • Artificial intelligence

Under NYC law, to use an AEDT, employers or employment agencies must:

  • Make sure a bias audit was done before using it
  • Post a summary of the results of the bias audit on their website
  • Notify job candidates and employees that an AEDT will be used to assess them
  • Give instructions to request a reasonable accommodation
  • Post a notice about the type and source of the data used for the tool and data retention policy on their website

File a Complaint

You can report an employer or employment agency that used an AEDT but did not:

  • Make sure the required bias audit was done
  • Post a summary of the results of the bias audit 
  • Give required notices

Your complaint must include:

  • Date of suspected violation
  • Explanation of suspected violation
  • Details of the job posting or position
  • Name and type of the AEDT, if known
  • Notice provided, if any
