Owners of residential buildings with 3 or more units must create a smoking policy for their buildings.

The policy must state where smoking is and isn't allowed on the property, both indoors and outdoors.

The law also requires that owners:

  • Share the policy with current and future tenants
  • Notify tenants yearly about the policy on smoking
  • Notify tenants if the policy on smoking changes

Building owners who don't follow the law may be fined.

To report a building owner who did not disclose or share a smoking policy with tenants or notify them to policy changes, email shscomplaints@health.nyc.gov.
